General Terms and Conditions for care 4 kids Families that purchase a membership subscription

1. General Conditions

care 4 kids GmbH as agent ("care 4 kids") arranges childcare personnel for families ("clients") who ask for such childcare services through a membership subscription. All services of care 4 kids are provided exclusively on the basis of the registration of the clients and these GTCs. Any additional agreements between care 4 kids and the clients require a written agreement.

2. Scope of Services

care 4 kids offers a comprehensive service in the search for personnel and relieves the client of a large part of the clarification and recruitment work. The caregiver is recruited and checked by care 4 kids to the best of its knowledge and belief. The position to be filled must therefore be clearly and unambiguously described. care 4 kids guarantees absolute discretion and puts the client in contact with suitable applicants. Each caregiver placed by care 4 kids is insured against personal injury and property damage up to CHF 10 million.

During the membership year, the clients are entitled to receive information on caregivers from the care 4 kids file. Based on the requirement profile, the client receives - after consultation between care 4 kids and the suitable caregiver - a short profile of the caregiver. The short profile is sent by mail. The clients arrange an appointment with the caregiver for an interview.

If the clients wish to have new profiles during their membership, either due to new care needs or due to the same needs, the search process starts anew. This search can last up to several weeks or until the membership expires without renewal.

care 4 kids cannot guarantee to find a suitable nanny in every single case, although care 4 kids is constantly successful in placing nannies. Clients have the benefit of unrestricted placement efforts by care 4 kids for 6 or 12 months, depending on the membership category.

The short profiles of potential nannies that are sent are confidential and may not be passed on to third parties by the clients. If the time requirement of a caregiver is higher than the selected membership category, the subscription will be adjusted to a higher level after consultation and invoiced (see membership categories info sheet). . The client is not allowed to contact a caregiver after the cancellation of a membership subscription.

3. Payment terms

The Membership subscription invoice is due for payment within 30 days of the date of issue.

Payment reminder will be sent after 31 days
1st reminder will be sent after 7 days in case of non-payment, plus reminder fees of CHF 25.00
2nd reminder will be sent after 5 days in case of non-payment after the 1st reminder, plus reminder fees of CHF 50.00

If no payment is made, legal steps (debt collection) will be initiated.

4. Cancellation of the Membership Subscription and costs

The subscription can be cancelled for important reasons within the first six weeks after conclusion. In the event of cancellation, a fee is payable for the expenses of care 4 kids, depending on the category of the subscription. As soon as a caregiver starts working for the client or after 42 days from the date of registration, the option to cancel the subscription expires.

Cancellation costs:

Mini Membership - CHF 300.00 excl. 8.1% VAT

Standard Membership - CHF 600.00 excl. 8.1% VAT

Premium Membership - CHF 900.00 excl. 8.1% VAT

5. Option of placing advertisements

In order to further increase the chances of success in finding the nanny they are looking for, clients have the option of choosing the targeted advertisement route. For each advertisement that care 4 kids designs, texts and places on behalf of the client, only the effective advertising costs - plus VAT - will be charged. All other expenses shall be borne by care 4 kids.

6. Contractual relationship between the client and the nanny

The client concludes the employment contract with the nanny and assumes all legally required registrations as well as the costs for insurance and social benefits. The Premium Membership includes the Full Administrative Set-up Kit (FASK). Clients are entitled to obtain their own references and request an extract from the criminal record. The clients of care 4 kids become employers of the caregiver with all rights and obligations according to the Swiss Code of Obligations and the standard employment contract for domestic workers.

7. Liability disclaimer

care 4 kids excludes any liability for damages of any kind to the extent permitted by law.

8. Data protection

care 4 kids complies with the provisions of the Swiss Data Protection Act (DSG). Personal data is only obtained or processed to the extent necessary for the business relationship.

9. Changes to the General Terms of Conditions

care 4 kids reserves the right to change these GTC's at any time. The current GTC's at the time of the use of the services apply.

10. Applicable law

Swiss law shall apply to the contractual relationship between care 4 kids and the clients. Zurich is agreed as the place of jurisdiction.
